I looked at a growers web site advertising that he is selling his seed stock rather than give it away. He stated his inputs were just too high to give seed away anymore. With the size of his operation and his inputs, it is obviously true. What I didn't notice is if he was permitted by Howard Dill to do this. Selling a protected seed variety without permission or compensation to the owner can get serious. The guys genetics and success are widely known, but I am not sure if what he is doing is legal? The only reason I ask is that I sell seed to farmers, and I could get in serious legal trouble if I peddled "bin run" seed of a protected variety.

How long can you claim legal rights to a seed variety before it becomes free to the public?

The PVP did expire in May of 2005. I believe it was about a 22-25 year one. Not sure, but I think that the length depends on a number of case specific things. AleX Noel.

Although the PVP expired, Howard Dill still owns his trademark. So if you sell the seeds, call them monster pumpkins, competition grade pumpkins or something else. You can't call them Dill's Atlantic Giant without his permission.

Im a newbie and dont know alot but i think i know who its is your speaking of and peaple buy seeds all the time and they all begain with a dills atlatic giant so technically where all in alot of trouble including those holding auctions. But one big thing this person does do is sell quality seeds with his last name attached which makes them his alone do do what he wants with them.When you grow a monster the seed stock gets your name of choice and it becomes yours to do whatever you may with it. may you and yours grow a huge orange monster pumpkin and best wishes during the season.

IF A PERSON WANTS TO SELL THEIR GIANT PUMPKIN SEED I DONT HAVE A PROBLEM WITH IT. MANY THAT HAVE GOOD QUALITY SEED WORTH SELLING COULD USE THE MONEY. LOOK AT WHATS AVAILABLE AT AUCTION THESE DAYS? TRUE THE MONEY RAISED AT THESE AUCTIONS GOES TOWARD THE SUPPORT OF GIANT PUMPKIN ORGANIZATIONS HOWEVER, ITS NO DIFFERENT THAN ME HOLDING THE "DICK WALLACE GIANT PUMPKIN SEED AUCTION" AND USING THE PROCEEDS TO IMPROVE MY QUALITY OF LIFE. I didn't want to offend anyone, it was just a question. Tom, I hope you aren't mad. You are correct though in selling your seed. You are in fact a form of farmer who needs income for his inputs. Hope it works for you. Maybe you will come up with the next best variety that you can patent. Maybe a giant bon bon squash? lol. Craig "herbie"
