Well I checked out the site but really was not impressed.
For one it is Canby Oregon, not Conby and
please excuse me but Bruce Whittier is probably not too happy to have his name spelled Bruce Whitter.
Sounds like a doctor created the site...

I REALLY hope you asked John and Ken before linking some/most of those pics. i'm not sure how they are with the whole intellictual property or whatever you want to call it, but some websites really take offense to that.

While completely unrelated to this situation, I have a friend with a similar dilema. Another message board/forum website for lawn care professionals.

Those of us who have posted solutions in print & photos have been challenged that our printed words no longer "belong" to us but rather to the website's owner. This friend has now opened his own competing website. He copied & pasted text that was previously placed at the "other site" into his new site. He authored this text himself originally but posted it to the original site to which he had no ownership. Now the original website owner is threatening litigation if the material isn't removed.

This situation (however unpleasant for my friend) sounds like it could be perfectly legal. That once text is printed on a website forum, the ownership of the content goes to the websites owner & not the author unless the author sought copyright protection first.

Does anyone know if this is correct?

If so, how does the author copyright his/her own words before posting them?

Clinton - Good idea to seek permission to use pictures & text before placing them on your site. I doubt you would be denied if you ask. Alternate pictures probably exist that are likely free for the asking. Do work with a proof reader. You'll deliver a finer product & probably expand your own horizons at the same time. Keep at it & good luck. It's a cool thing to do!

It's always nice to see someone want to take the time to put up a web site and the only way to learn is to make a few mistakes. Appreciate the time others have put into their sites as well and always ask before copying content from another site it is not just good courtesy it in some cases is the law.

That said have a look at www.giantveggies.com it is an exact duplicate of my personal website.

Do I own Giant Veggies.com

NO and unforunately a member of this website and a giant pumpkin grower registered the name before me. Yes it was totally legal as I have no legal right to the name YET.

However He copied EVERY THING from my site at http://www.members.shaw.ca/giantveggies/ and then offered to sell me the name.

It is clear there is copyright on all pages yet he still went ahead and copied and reposted the pages to his site with out asking.

To make it short my Lawyer has now been instructed to start legal action against this individual.

It looks to me like he/she was not trying to rip your site off. Looks like they were just making it look like yours for a sell job.

It's obvoiously set up as 'your' web site... has your signature and everything! LOL (probably not funny to you).

I've been known as "kilrpumpkins" for the past 7 years. It's bad enough that now he is going by my nickname "kilr" (which I have used for 24 years), and that he is using one of my photos on his site without my permission, Bigpumpkins.com isn't the only one getting ripped off! Sounds to me like "identity theft"! I surely don't want anyone out there confusing the two of us!

Imitation is one thing, but that website is a total bootleg of ours. In the past we had given some leeway, but this is ridiculous. In fact, it would be too difficult to tell you what to take down. It would be easier to tell you what you could keep…

After taking a closer look we noticed that almost all of your images are actually being hosted by our server! I can’t even begin to explain how offensive this website is to us.

Please take it down immediately.

I am sure you didn’t realize the extent of what you were doing. This message may seem harsh, but we have to protect our content.

John and Ken i am so sorry about my website i thought i could do that but i learned from my mistakes. I am really sorry about that i wanted to make a website just a good as this one. You now i can not stay off this site this site is like my life. I wanted to start a website last year and i could not find a server and now i found one it took m 3 weeks to make that website before i posted on here and now i have to change it will be a little bit before i can change it ok John and Ken. I am truely sorry about makeing you mad at me and i still want you to trust in me but i have learned from my mistakes and will never do it again unless i ask if it is ok to do something like a did.Clinton

You really need to remove your site out of respect for those you stole information from. Not to mention the fact that you are stealing bandwidth from bp.com everytime some views your site because all of your pictures are pulled from here rather than your host. This is bad form. You could get in some trouble. Take it down.

I really hate coming to the Bp.com website and have to sift through post such as this. I have taken it upon myself and time away from my other million things to help resolve this issue you seem to ignore.
